CANCELLATION OF REMOVAL FOR LAWFUL PERMANENT RESIDENTS
There are many reasons that you may be placed in removal proceedings. Removal proceedings can be very scary. However, if you meet the requirements below, you may be eligible for relief from removal.
Section 240A(a) of the Immigration and Nationality Act (INA), states that the Attorney General may cancel removal in the case of an alien who is inadmissible or removable from the United States if the individual:
Has been a lawful permanent resident (LPR) for at least five years;
Has resided in the United States continuously for seven years after having been admitted in any status;
Has not been convicted of an aggravated felony;
Has not previously received a grant of cancellation, suspension of deportation under former section 244(a), or relief under former section 212(c); and
Warrants the relief as a matter of discretion.
